Penalties for Overprescribing Opioids

Law enforcement is coming down hard on alleged doctors who overprescribe opioids. In fact, in February 2019, the U.S. Attorney’s Office issued a press release stating that more than 180 medical professionals in Wisconsin were cautioned about their opioid prescribing practices. These letters were part of a broader federal effort to curtail the opioid crisis nationwide. While these letters acknowledged that many of the opioid prescriptions written for patients were for a legitimate purpose, it warned prescribers they could be held legally responsible for overprescribing through criminal prosecution.

The penalties a physician may face for overprescribing opioids varies based on the facts of the case but can be very serious. Depending on the scope of the violation, it can be a misdemeanor or felony charge.

Doctors convicted of overprescription, per the California Health and Safety Code Section 11153, may face:

  • Up to 1 year in jail
  • A fine up to $20,000
